ARTICLE 1 - Scope of application :

1a The purpose of the present general conditions of sale is to govern the contractual relations between us, namely PA DESIGN and you, namely the customer, defined below as being the user of the website accepting the present general conditions of sale.

1b These general conditions of sale specify in particular the conditions of orders, payments, deliveries and management of the possible returns of the articles ordered by the customer.

1c The customer can consult simply, freely and at any time these general conditions of sale by clicking on the link "conditions of sale". Thus, any order of articles placed by a customer will imply the final and irrevocable agreement of the customer on all the general conditions of sale presented hereafter.


ARTICLE 2 - Method of order taking:

2a If the customer wishes to place an order, he will fill out, according to the indications which are provided to him on line, a form placed at his disposal where he will make appear the information necessary for his identification and in particular his: name, first name, postal address, telephone number and e-mail.

2b The customer having chosen the articles presented, will definitively validate his order, in view of a summary displayed on the screen, by "clicking" to show his commitment and his acceptance of the general conditions of sale. From this moment, the order is recorded and is irrevocable on his part.

2c Any order placed with PA DESIGN, through its website, will be confirmed to the customer by sending an order confirmation as soon as possible and according to the following modes: e-mail, or mail.

2d No cancellation of order will be accepted without the prior agreement of PA DESIGN.

2e The photos and descriptions of the articles have been created by PA DESIGN or communicated to PA DESIGN by the manufacturers of the products. In accordance with the article L.111-1 of the Code of Consumption, tries to give a maximum of precisions on the sold products. It should however be noted that, for technical reasons, it can happen that the final product can slightly vary from the photograph of this one.

2f PA DESIGN advises the customers who order directly on its Internet site to record or print a copy of the purchase order until reception of the E-Mail of confirmation of order addressed to the customer by PA DESIGN.


ARTICLE 3 - Method of payment :

3a All the purchases carried out on the site are payable with the order. This means that no product can be dispatched to a customer if this one did not regulate as a preliminary 100% of the selling price including all taxes of the product as well as the possible related expenses of delivery.

3b So that no dispute on the sums paid by the customer can occur, PA DESIGN always sends to the customer a confirmation of the registration of his order.

3c PA DESIGN reserves the right to suspend any order management and any delivery in case of refusal to authorize payment by credit card and/or any other payment from officially accredited organizations or in case of non payment and/or fraud and to prosecute the author(s) of the latter.

3d PA DESIGN reserves in particular the right to refuse to carry out a delivery or to honour an order emanating from a customer who would not have paid totally or partially a previous order or with whom a payment dispute would be in the course of administration.

3e PA DESIGN reserves the right to pursue all attempts to use fraudulent means of payment and/or to settle fraudulent payment disputes or fraudulent payment attempts amicably in return for a payment of the amount due by the customer, plus possible file fees.

3f You have for the moment 2 means of payment:

ARTICLE 4 - Information on the articles :

4a The PA DESIGN website presents the items for sale with the necessary characteristics to comply with article L 111-1 of the Consumer Code, which provides the possibility for the potential buyer to know before the final order the essential characteristics of the items to be sold.

4b The photos and descriptions of the articles have been created by PA DESIGN or communicated to PA DESIGN by the manufacturers of the products. In accordance with article L.111-1 of the Consumer Code, PA DESIGN seeks to give a maximum of details on the products sold. However, it should be noted that, for technical reasons, it may happen that the final product may vary slightly from its photograph.

4c The articles and prices presented on the website are valid only within the limits of available stocks and do not give rise to any compensation in the event of breakage or cancellation.


ARTICLE 5 - The prices :

5a The selling prices of the articles are expressed in Euros all taxes included (€ TTC).
 Orders with a delivery address outside the EEC are invoiced in prices excluding VAT (20% VAT deducted). The buyer must pay on delivery the various customs taxes governed by the regulations of the country of delivery. Pa Design can in no way be forced to reimburse or deduct these taxes. Pa Design is committed to shipping orders outside the EEC accompanied by a customs declaration corresponding to the contents of the package, to allow for an exact calculation of customs fees.

5b The prices of the articles can change at any time. The selling price retained for the purchase of a product corresponds to that observed on line at the time of the recording of the order on the Internet site

5c The possible expenses of delivery and insurances are chargeable to the customer and are invoiced in supplement of the selling price of the articles. 

5d The customer will always be informed before the final recording of his order of the delivery costs related to the said order, and the payment will be requested from the customer for the total amount of the purchase, integrating the prices of the ordered articles plus the delivery costs. Thus, the confirmation of agreement by the customer to pay for the order implies that the customer agrees to pay the related delivery costs. The delivery costs cannot therefore constitute a valid reason for questioning the order after it has been definitively registered.

5e For an order of an amount greater than or equal to 30 euros, delivery costs are only offered for delivery in metropolitan France by PICKUP relais, company DPD, .

ARTICLE 6 - Delivery terms :

6a The articles bought on the site of can be delivered in Metropolitan France in Europe EU and Switzerland.
The customer chooses the mode of delivery: PICK UP RELAIS, on Appointment at home via Predict, company DPD or COLISSIMO for France. Delivery will only be made by colissimo for Corsica, the coastal islands, EU Europe and Switzerland. 

6b Delivery is made to the address specified by the customer at the time of purchase. It will be carried out by La Poste or by a carrier or by collection at a point here. It can only be made once the order has been validated by the customer and payment has been made in full. The bank payment centres concerned will therefore have given their prior agreement to payment. In the event of refusal by the said centres, the order will be automatically cancelled.

6c In the event of the customer's absence at the time of delivery, a delivery notice will be left in the customer's letter box inviting him to collect his parcel from the post office for colissimo deliveries. A contact will be established by the company DPD for delivery by Predict appointment. Packages delivered by PICKUP relay are kept 9 days in the relay.
The customer will be notified beforehand of the dispatch and then of the availability of his parcel.
If a parcel is returned to our premises because it has not been claimed, the shipping costs for a new delivery will be borne by the client, even for an order initially placed carriage paid.

6d The delivery will be considered as made from the date of the first presentation of the goods to the delivery address indicated by the customer when placing the order. The delivery of the goods will be carried out against signature by the receiving customer of a delivery note.

6e The customer is obliged to check the conformity of the goods delivered at the time of delivery, before signing the delivery note.

6f Any anomaly concerning the delivery (damage, missing product compared to the delivery note, damaged package, broken products...) must be imperatively indicated on the delivery note in the form of "handwritten reserves", accompanied by the customer's signature. At the same time, the customer must confirm this anomaly by sending the carrier within three (3) working days following the delivery date a registered letter with acknowledgement of receipt setting out the said claims. The reservations on the package in case of damage must be precise (e.g.: open package, wet, broken goods etc...) ATTENTION: the mention "subject to unpacking" is not valid in the case of damage.

6g The customer will have to transmit a copy of this mail by fax or by simple letter to PA DESIGN. 


ARTICLE 7 - Delivery times :

7a If the article ordered is available in stock, PA-Design commits to deliver your order within 2 to 3 working days (Monday/Friday) outside our annual closures announced before payment (one week between Christmas and New Year's Day and 4 weeks in summer). Parcels are handed over to the carriers from Monday to Thursday during normal periods, and from Monday to Friday from October to December. The delivery time will be communicated to you directly by the carrier, it is on average 1 to 2 days for France and 2 to 4 days for Europe. In no case Pa Design can be held responsible for a delay in the delivery of the parcel. In case of payment by cheque, the delay of order processing takes effect at the reception of the cheque, and not at the validation of the cheque.

7b Delivery times will only start from the date of payment of the order.

7c In case of force majeure or exceptional events (natural disaster, epidemic, strikes, etc.) delaying or prohibiting the delivery of goods, PA DESIGN is released from all responsibility.
 In case of loss of the package by the carrier, Pa Design commits itself to make a new shipment of the articles in stock, and/or to propose a compensation, which cannot exceed the value of the order. If the "lost" parcel is finally sent, the customer will have to refuse the delivery or return the parcel to Pa Design, otherwise he will be indebted for the value of the order.

7d In any case, the delivery within the deadlines can intervene only if the customer is up to date of his obligations towards PA DESIGN.

7e In case of unavailability on the part of PA DESIGN to deliver within the indicated deadlines, it will be proposed to the customer a replacement product at a price equivalent to his purchase or the reimbursement of his purchase purely and simply.


ARTICLE 8 - Complaints :

8a The customer must formulate to PA DESIGN on the day of delivery or at the latest on the first working day following the delivery, any complaint of delivery error and/or non-conformity of the articles in kind or in quality compared to the indications appearing on the delivery note. Any complaint made after this deadline will be rejected.

8b The formulation of this complaint to PA DESIGN will be made by registered letter.

8c In accordance with articles L. 211-1 to L. 212-1 of the Consumer Code, and articles 1641 to 1649 of the Civil Code, the time limit for denouncing a lack of conformity or a hidden screw is extended to 2 years from the delivery of the goods.

8d Any complaint not made in accordance with the rules defined above and within the time limit cannot be taken into account and will release PA DESIGN from any responsibility towards the customer.


ARTICLE 9 - Satisfied or reimbursed:

9a As from the delivery date of your order, you have 14 clear days to exercise your right of retraction (the delivery and return costs remaining at the customer's expense).

9b To exercise this right of retraction, PA DESIGN suggests you contact the Customer Service either by email at, or by phone at 09 52 74 19 73 (non surcharged call) in order to indicate the forthcoming return.

9c Refunds will be made a few days after receipt of the product according to the means of payment used for the Order and at the latest within thirty (30) days from receipt of the exercise of the right of retraction. 

Only the return or exchange of items received in their original packaging, complete (accessories, instructions, etc.), in perfect condition for resale (not soiled, damaged or worn) will be accepted. 

The cost of returning the item remains at the customer's expense, except in the event of a lack of conformity or proven hidden defects in the product. 


ARTICLE 10 - Reservation of ownership and responsibility:

10a PA DESIGN remains the owner of the goods until they have been fully paid for by the client. The transfer of property of the articles to the customer is carried out at the time of the integral payment of the price. However during the period from delivery to the transfer of ownership, the risks of loss, theft or destruction are the responsibility of the customer.

10b The non-fulfilment by the customer of his payment obligations, for whatever reason, gives PA DESIGN the right to demand the immediate restitution of the goods delivered at the customer's expense, risk and peril (any eventual restoration of the articles will be at the customer's expense).

ARTICLE 11 - Invoicing :

The delivery note will be given in the parcel, the invoice will be printable on the site, the customer can however ask, at the time of his order, in the commentary insert, that the invoice be included in the parcel.

ARTICLE 12 - Rights of access and rectification :

12a PA DESIGN is concerned about the protection of the private life of the customer placing an order on its Internet site and treats the information concerning it with the strictest confidentiality. During a purchase made by the customer, only the essential information is requested (name, first name, address, e-mail, etc...) for a quality treatment and a careful follow-up of the order.

12b In accordance with the provisions of the CNIL, the customer has the right to access, modify, rectify and delete data concerning him/her (article 34 of the "Informatique et Libertés" law of 6 January 1978).


ARTICLE 13 - Jurisdiction :

13a The general terms and conditions of sale set out above are governed by French law. According to articles 46 and 48 of the Code of Civil Procedure and L. 141-5 of the Consumer Code, any dispute concerning these general terms and conditions of sale shall be submitted by the consumer either to the Commercial Court of Paris, or to the jurisdiction of the place where he or she resides at the time of the conclusion of the contract or the occurrence of the harmful event.
